Definitions and information collected
a. “Customer Information” refers to any information related to you or your Orby TV Service, including your personal information, Subscriber Account Information, System Information, Diagnostic Information, and Interactive Service Information.
b. “Subscriber Account Information” means information about your Orby TV Service account, including, but not limited to, your name, address, email address, telephone number, programming packages, the Orby TV distributor, if any, through which you purchased your Orby TV equipment, privacy preferences, the start date and any information reasonably related to your registration and maintenance of the Orby TV Service.
c. “System Information” refers to the information necessary for us to provide the service to your Orby TV equipment. Examples of System Information include the software version number and serial number of the Orby TV receiver.
d. “Orby TV Service” refers to the end-to-end video system that Orby TV makes available, including the programming package offerings as they are described on our website. The Orby TV Service includes (i) programming and other content, (ii) software, firmware, data models, templates, data integration tools or technologies, data processing systems or mechanisms, software code, including objects and tools, trade secrets, know-how and related processes; and (iii) all inventions, discoveries, works of original authorship and works derived from them, developments, concepts and improvements related to the foregoing, regardless of whether they were created or utilized by Orby TV.
e. “Orby TV Equipment” refers to the Receiver, satellite dish and over-the-air antenna (including the mounting hardware), and the cables, power cord and remote control that are included with the Receiver in the original packaging.
f. “Orby TV Receiver” refers to the digital Orby TV receiver or DVR that connects to the user’s television and provides video and other services.
g. “Diagnostic Information” refers to the data and / or detailed information about the operation of the Orby TV Equipment. We may collect Diagnostic Information from your Orby TV Receiver for quality control and troubleshooting and to help us better operate the Orby TV Service. These records identify your Orby TV Equipment and are therefore associated with your subscriber account.
h. “Commercial Information” refers to the subscriber’s account information that allows a business affiliate to complete their request to participate in a promotion or transaction.
i. ” Aggregate Information” refers to information that does not identify you and that may be combined with other information anonymously or without identification.
- Aggregate information about website visitors: we create aggregate reports of visitors to our websites to measure the performance of our sites. These reports do not contain Customer Information.
- Aggregate information about interactive services and applications: we create global reports about the users of our services and interactive applications to measure performance and for quality control and problem-solving purposes. These reports contain Diagnostic Information. If you have logged in to your Orby TV customer account while using one of our interactive applications, the Diagnostic Information will be associated with your Orby TV customer account and, therefore, certain reports may also contain other Customer Information.
Use of Customer Information
We use Customer Information to provide our service to our customers and to understand what they want in order to continue providing a compelling entertainment product at a good price. Specifically, we use Customer Information for editorial purposes, feedback, marketing and promotion, statistical analysis, product development and content improvement, to verify customer ability to receive our service, to charge for our service and for other related business purposes. We may use Customer Information to provide, within our video services and interactive services and applications, advertisements for goods and services that may be of interest to you. We may collect Customer Information directly from you and indirectly through retailers and other Orby TV partners, including entities that can help us make this service available to you. We collect this information when you activate or change your service and also from third parties, such as consumer reporting agencies and consumer data companies. We may combine the information we collect from third parties with the Customer Information we collect.
When we disclose information
We share customer information with third parties when necessary to carry out legitimate business activities related to the service to our customers, including the following cases:
Aggregate and anonymous purchase information: we may disclose aggregate and / or anonymous information about program purchases, along with any type of derivative analysis, to third parties, including suppliers, advertisers, broadcasters, research companies and other organizations, without limitations.
When you choose to participate in a special offer or engage in a transaction with Orby TV or an external advertiser or promoter, we will collect and disclose your Customer Information, on your behalf, to the third party that sponsors or enables the promotion. This information is disclosed only in response to an affirmative response to an offer. In addition to carrying out your request, that party may also use your Customer Information to send you other information in which you may be interested, in accordance with its own privacy policies.
Legal requirements: we may share Customer Information with third parties to comply with legal requirements, in response to a legal proceeding or in cases where the law allows, to protect our rights or property, including cases in which we fight against identity theft or to investigate a billing fraud. In most cases in which the disclosure is made in accordance with a legal procedure, we will provide you with a prior notice of said court order or court order so that you have the opportunity to challenge such order through a legal proceeding or request.
Online payment transactions
We protect the security of payment transactions made through the Internet through a secure and encrypted web server. We keep all information (including credit, debit and bank account information) collected during transactions in a secure database for accounting and billing purposes. While in these databases, the information on your credit, debit and bank account will not be available for unauthorized parties. The stored information from transactions with credit cards, debit cards and bank accounts will not be disclosed to third parties except in the case of a summons or court order.
Your choices regarding our collection and use of Customer Information
You may choose not to allow us to share your Customer Information with third parties for direct marketing purposes by means of a notification sent by email to customercare@OrbyTV.com or by telephone, by calling 877-672-9881. You may choose not to receive communications that we send you based on your Subscriber Account Information. If you decide this, you understand that we will not be able to inform you about any new function, improvement or promotion related to your Orby TV service. However, in all cases, we will collect and use your Subscriber Account Information (including your Service Information) and Diagnostic Information for legitimate business purposes.
How long we keep Customer Information
We keep information about you as long as we provide you with services and for more time for related business activities. After the information is no longer necessary for our business purposes, we destroy the information unless there is a request or request for preservation of the pending information.
Our do not contact policy
We may communicate with you by email, text message or telephone to tell you about additional products or services that we or third parties may offer. If you do not wish to receive such calls or promotional materials, you can notify us by telephone, email or postal mail by means of the contact information provided below. How we protect the security of Customer Information
We take reasonable measures to protect Customer Information through security technologies and procedures that limit access to our databases. However, no system is completely secure or free of errors. We do not guarantee, nor can we guarantee, the total security of Customer Information.
How you can get access to your information
You can update or change your contact information, billing information and privacy preferences collected and stored by Orby TV. You can make a request by phone, mail or online (if available and when available) to review that information and we will take all reasonable steps to make the request. If you request that certain parts of such information be changed, we will make the changes to the extent that they are commercially possible.
